Collective Redress for Mass Harm in Ireland 330 8 $aThis monograph addresses the phenomenon of mass harm and how it may be resolved through collective redress. It examines particularly how such redress may be achieved through mechanisms such as multi-party actions (MPAs). In order to do this, an analytical framework is created against which to evaluate various multi-party procedures. This is illustrated through the experience of a selection of common law jurisdictions in dealing with mass harm - namely that of England and Wales, Canada, Australia and the United States, as well as that of EU collective redress. It examines multi-party action laws benchmarked against the objectives identified in the analytical framework. The phenomenon of environmental mass harm in particular is explored as a case study, as it illustrates some of the difficulties that may arise in mass harm litigation. Also, this work explores where the best solutions for mass harm redress may lie in the future - perhaps in collective actions or through alternatives such as regulation and alternative dispute resolution or a combination of these. Finally, the experience of mass harm litigation in Ireland is examined, as currently this jurisdiction does not have an effective mechanism for dealing with mass harm 410 0$aCivil justice systems ;$vVolume 4. 606 $aClass actions (Civil procedure) 606 $aJoinder of actions 606 $aLiability for environmental damages 615 0$aClass actions (Civil procedure) 615 0$aJoinder of actions. 615 0$aLiability for environmental damages. 676 $a344.04/6 700 $aBlennerhassett$b Joanne$01863125 801 0$bUtOrBLW 801 1$bUtOrBLW 801 2$bUkLoBP 906 $aBOOK 912 $a9910953732503321 996 $aA comparative examination of multi-party actions$94469587 997 $aUNINA LEADER 03782nam 22007811c 450 001 9910962574103321 005 20251211121144.0 010 $a9786612526022 010 $a9781472547767 010 $a1472547764 010 $a9781282526020 010 $a1282526022 010 $a9781441152251 010 $a1441152253 024 7 $a10.5040/9781472547767 035 $a(CKB)2670000000013676 035 $a(EBL)495360 035 $a(OCoLC)609858464 035 $a(SSID)ssj0000366785 035 $a(PQKBManifestationID)12084045 035 $a(PQKBTitleCode)TC0000366785 035 $a(PQKBWorkID)10435617 035 $a(PQKB)11416340 035 $a(MiAaPQ)EBC495360 035 $a(Au-PeEL)EBL495360 035 $a(CaPaEBR)ebr10373298 035 $a(CaONFJC)MIL252602 035 $a(OCoLC)614455262 035 $a(UtOrBLW)bpp09256028 035 $a(PPN)15802964X 035 $a(UtOrBLW)BP9781472547767BC 035 $a(Perlego)806093 035 $a(EXLCZ)992670000000013676 100 $a20140929d2010 uy 0 101 0 $aeng 135 $aur|n|---||||| 181 $ctxt 182 $cc 183 $acr 200 10$aTime and becoming in Nietzsche's thought $fRobin Small 210 1$aLondon $aNew York $cContinuum $d2010. 215 $a1 online resource (215 p.) 225 1 $aContinuum studies in Continental philosophy 300 $aDescription based upon print version of record. 311 08$a9781441147943 311 08$a1441147942 311 08$a9781441189653 311 08$a1441189653 320 $aIncludes bibliographical references (pages [191]-196) and index 327 $aAbsolute becoming -- From becoming to time -- The time-atom theory -- Motion, ways, and time -- Gateway and lanes -- Linear and circular time -- The eternal perspective -- The way of greatness 327 $aPreface -- Introduction -- 1. Yet few have been as radical in their thinking as Friedrich Nietzsche. Time and Becoming in Nietzsche's Thought explores Nietzsche's approach to temporality, showing that his metaphorical and literary presentations lend themselves, in surprising detail, to the debates that have engaged other thinkers. Like Heraclitus, Nietzsche is a philosopher of becoming who sees reality as a continual flow of change. Time is an interpretation of becoming, designed to enable its tensions and fluctuations to be grasped conceptually by our minds. From this starting point, Robin Small explores the emergence of sharply contrasting models of temporality which express differing forms of life. The book concludes with a return to Nietzsche's Dionysian vision of playful participation in becoming as a never-ending creation and destruction. Time and Becoming in Nietzsche's Thought reveals Nietzsche as a major contributor to our thinking about temporality and its significance for human life. 410 0$aContinuum studies in Continental philosophy. 606 $aTime 606 $aBecoming (Philosophy) 615 0$aTime. 615 0$aBecoming (Philosophy) 676 $a115.092 686 $a5,1$2ssgn 686 $aCG 5917$2rvk 700 $aSmall$b Robin$f1944-$0918023 801 0$bUtOrBLW 801 1$bUtOrBLW 801 2$bUkLoBP 906 $aBOOK 912 $a9910962574103321 996 $aTime and becoming in Nietzsche's thought$94470958 997 $aUNINA
