In the last few years, their intersection has become increasingly important and problematic. These lectures seek to define the problem and to provide acceptable solutions where possible. They attempt to derive support from both a stringent dogmatic approach and pragmatic attention to real-life expectations and conduct. More so than in other areas of private international law, the intersection between the powers of the arbitrator and the illegality of the subject matter or the parties? conduct poses a particular challenge. That challenge is to postulate proper solutions under the law, including principles of transnational or international law, to conduct which can take on a multiplicity of appearances owing to conflicting cultural understandings of what is and is not legal in commercial life. The statement that bribery and corruption offend transnational or international public policy does not relieve the arbitrator from the burden of scrutinizing that statement doctrinally and exploring its consequences in a period of ever-increasing globalization of economic activity and investment. 410 0$aThe Pocket Books of The Hague Academy of International Law / Les livres de poche de l'Académie de droit international de La Haye$v20. 606 $aInternational commercial arbitration 606 $aCompetent authority 606 $aIllegal contracts 606 $aArbitration agreements, Commercial 606 $aConflict of laws$xContracts 606 $aCorruption 606 $aBribery 606 $aArbitration agreements, Commercial$2fast 606 $aBribery$2fast 606 $aCompetent authority$2fast 606 $aConflict of laws$2fast 606 $aCorruption$2fast 606 $aIllegal contracts$2fast 606 $aInternational commercial arbitration$2fast 608 $aContracts.$2fast 615 0$aInternational commercial arbitration. 615 0$aCompetent authority. 615 0$aIllegal contracts. 615 0$aArbitration agreements, Commercial. 615 0$aConflict of laws$xContracts. 615 0$aCorruption. 615 0$aBribery. 615 7$aArbitration agreements, Commercial. 615 7$aBribery. 615 7$aCompetent authority. 615 7$aConflict of laws. 615 7$aCorruption. 615 7$aIllegal contracts. 615 7$aInternational commercial arbitration. 676 $a341.522 700 $aKreindler$b Richard H$0261322 712 02$aHague Academy of International Law. 801 0$bNL-LeKB 801 1$bNL-LeKB 906 $aBOOK 912 $a9910808732903321 996 $aCompetence-competence in the face of illegality in contracts and arbitration agreements$92253805 997 $aUNINA
