Der nationale Gesetzgeber setzt sich neuerdings immer intensiver für die Sicherung der Qualität und Seriosität des Angebotes am Lebensversicherungsmarkt ein, u.a. durch die Anpassung der branchenspezifischen Bilanzierungsvorschriften für die Versicherungsunternehmen an neue Rahmenbedingungen. Ein Beispiel dafür stellt eine Gesetznovellierung in Form des Versicherungskapitalanlagen-Bewertungsgesetzes (VersKapAG) dar, das klare Zielsetzung hatte - durch die Möglichkeit, die vorübergehende Schwankungen des Wertes von Wertpapieren nicht als Abschreibungen, sondern in Form stiller Lasten bilanziell zu erfassen, soll die Überschussbeteiligung von den vorübergehenden Schwankungen der Werte geschützt werden. Da die HGB-Rechnungslegung traditionell eine Reihe von unbestimmten Rechtsbegriffen, muss zunächst Gewährleistung der Objektivität der Anwendung überprüft werden.
