Law and Rhetoric in the School Controversies sheds new light on a much debated issue in the field of Roman law, id est the so-called 'school controversies' between the Sabinians and the Proculians. Tessa Leesen rejects the general assumption in modern literature that the two schools each adhered to a fundamentally different theoretical conception of law. She argues that the 'school controversies' as described in Gaius' Institutiones arose in legal practice when the heads of the two schools were consulted by two conflicting parties and each gave opposing advice. In order to make their opinions persuasive, the jurists were in need of adequate arguments. For this purpose, they made use of rhetoric and of the argumentative theory of topoi as described in Cicero's Topica . 410 0$aLegal history library ;$vv. 2. 606 $aRoman law$xHistory 615 0$aRoman law$xHistory. 676 $a340.5/4 700 $aLeesen$b Tessa G$0510880 801 0$bMiAaPQ 801 1$bMiAaPQ 801 2$bMiAaPQ 906 $aBOOK 912 $a9910788483403321 996 $aGaius meets Cicero$9767782 997 $aUNINA LEADER 01274nas 2200421- 450 001 9910338751403321 005 20240517213015.0 035 $a(OCoLC)786453382 035 $a(CKB)2560000000057895 035 $a(CONSER)--2023221029 035 $a(DE-599)ZDB2727077-4 035 $a(EXLCZ)992560000000057895 100 $a20120227a19939999 --- - 101 0 $aeng 135 $aurmnu|||||||| 181 $ctxt$2rdacontent 182 $cc$2rdamedia 183 $acr$2rdacarrier 200 00$aAl-Rafidain engineering journal 210 1$aMosul City, Nineveh Governorate, Iraq :$cCollege of Engineering, University of Mosul 215 $a1 online resource 311 08$a1813-0526 517 1 $aAl-Rafadain engineering journal 517 1 $aRafadain engineering journal 517 1 $aAREJ 606 $aEngineering$vPeriodicals 606 $aIngénierie$vPériodiques 606 $aEngineering$2fast$3(OCoLC)fst00910312 608 $aPeriodicals.$2fast 608 $aPeriodicals.$2lcgft 615 0$aEngineering 615 6$aIngénierie 615 7$aEngineering. 712 02$aJ?mi?at al-Maw?il.$bKull?yat al-Handasah, 906 $aJOURNAL 912 $a9910338751403321 996 $aRafidain Engineering Journal$92283501 997 $aUNINA
