Yet, with prevention comes prediction: the need to identify and detain those considered likely to engage in a terrorist act in the future. The detention of "suspected terrorists" is intended, therefore, to thwart a potential terrorist act recognising that retrospective action is of no consequence given the severity of terrorist crime. Although preventative steps against those reasonably suspected to have an intention to commit a terrorist act is sound counter-terrorism policy, a law allowing arbitrary arrest and detention is not. A State must carefully enact anti-terrorism laws to ensure that preventative detention does not wrongly accuse and grossly slander an innocent person, nor allow a terrorist to evade detection. This book examines whether the preventative detention of suspected terrorists in State counter-terrorism policy is consistent with the prohibitions on arbitrary arrest and detention in international human rights law. This examination is based on the "principle of proportionality"; a principle underlying the prohibition on arbitrary arrest as universally protected in the Universal Declaration of Human Rights, and given effect to internationally in the International Covenant on Civil and Political Rights, and regionally in regional instruments including the European Convention on Human Rights.

The book is written from a global counter-terrorism perspective, drawing particularly on examples of preventative detention from the UK, US and Australia, as well as jurisprudence from the ECHR"--$cProvided by publisher. 410 0$aRoutledge research in terrorism and law. 606 $aPreventive detention 606 $aTerrorism$xPrevention$xLaw and legislation 606 $aHuman rights 615 0$aPreventive detention. 615 0$aTerrorism$xPrevention$xLaw and legislation. 615 0$aHuman rights. 676 $a345/.0527 686 $aLAW000000$aLAW051000$2bisacsh 700 $aMacken$b Claire.$0846212 801 0$bMiAaPQ 801 1$bMiAaPQ 801 2$bMiAaPQ 906 $aBOOK 912 $a9910778816803321 996 $aCounter-terrorism and the detention of suspected terrorists$93822593 997 $aUNINA LEADER 04028nam 22008175 450 001 9910437882303321 005 20251230065319.0 010 $a9781299335882 010 $a1299335888 010 $a9783642355677 010 $a3642355676 024 7 $a10.1007/978-3-642-35567-7 035 $a(CKB)2670000000337195 035 $a(EBL)1106294 035 $a(OCoLC)827212098 035 $a(SSID)ssj0000879547 035 $a(PQKBManifestationID)11487988 035 $a(PQKBTitleCode)TC0000879547 035 $a(PQKBWorkID)10852538 035 $a(PQKB)10826347 035 $a(DE-He213)978-3-642-35567-7 035 $a(MiAaPQ)EBC1106294 035 $a(PPN)168328917 035 $a(EXLCZ)992670000000337195 100 $a20130202d2013 u| 0 101 0 $aeng 135 $aur|n|---||||| 181 $ctxt 182 $cc 183 $acr 200 10$aProceedings of the 2nd International Conference on Green Communications and Networks 2012 (GCN 2012): Volume 2 /$fedited by Yuhang Yang, Maode Ma 205 $a1st ed. 2013. 210 1$aBerlin, Heidelberg :$cSpringer Berlin Heidelberg :$cImprint: Springer,$d2013. 215 $a1 online resource (777 p.) 225 1 $aLecture Notes in Electrical Engineering,$x1876-1119 ;$v224 300 $aDescription based upon print version of record. 311 08$a9783642355660 311 08$a3642355668 327 $aIntelligent Control -- Efficient Management -- Optimal Design of Access Network Infrastructures -- Home Networks -- Terminal Equipment. 330 $aThe objective of the 2nd International Conference on Green Communications and Networks 2012 (GCN 2012) is to facilitate an exchange of information on best practices for the latest research advances in the area of communications, networks and intelligence applications. These mainly involve computer science and engineering, informatics, communications and control, electrical engineering, information computing, and business intelligence and management. Proceedings of the 2nd International Conference on Green Communications and Networks 2012 (GCN 2012) will focus on green information technology and applications, which will provide in-depth insights for engineers and scientists in academia, industry, and government. The book addresses the most innovative research developments including technical challenges, social and economic issues, and presents and discusses the authors? ideas, experiences, findings, and current projects on all aspects of advanced green information technology and applications.
