En todas estas reformas, el legislador ha utilizado el argumento de una sociedad que reclama penas ma?s duras, sin sustento cienti?fico alguno, apoya?ndose en la idea del populismo punitivo. Adema?s, se ha utilizado a las vi?ctimas como arma arrojadiza, que se han convertido en peldan?os de una escalera para llegar al mayor nivel de castigo posible, la cadena perpetua. La escalada punitivista iniciada con el cumplimiento i?ntegro y efectivo de las penas, que en algunos casos daba lugar a una cadena perpetua de facto, ha acabado convirtie?ndose en una cadena perpetua de derecho, bajo el nombre de prisio?n permanente revisable. Una pena sobre la que sigue pendiente de resolucio?n un recurso de inconstitucionalidad por vulnerar numerosos preceptos de la Constitucio?n. Una pena que parte de la idea de sujetos irrecuperables, a los que hay que apartar de la sociedad. Una pena que deja de reconocer derechos fundamentales a aquellas personas que han cometido delitos especialmente graves. Una pena al fin y al cabo que nos ha hecho retroceder como Estado Social y Democra?tico de derecho. Mari?a del Mar Marti?n Arago?n, doctora en Derecho, es profesora de Derecho penal en la Universidad de Ca?diz. Se ha formado como investigadora en el extranjero en el Departamento de Criminologi?a de la Universidad de Leicester en 2016 y en Centre for Criminology and Sociolegal Studies de la Universidad de Toronto en 2018.
