In the absence of physical injury, compensation is not normally available for negligently caused mental suffering, however severe, unless it constitutes a 'recognisable psychiatric illness'. Claimants whose mental trauma stems from injury caused to someone else are subject to arbitrary restrictive liability rules that dispense with established legal principles and cannot be reconciled with scientific advances. The book traces the history of civil liability for mental harm up to the present day. It is argued that the reluctance to provide redress reflects an enduring suspicion of intangible injury and undue fear of proliferating claims. The scale and legal ramifications of the Hillsborough disaster; the emergence of claims arising from work-related stress, and other new categories of claims based mainly on prior relationships between the parties, have all added to a 'floodgates fear' that has intensified due to popular perceptions of a 'compensation culture'. The book contrasts the limited scope for liability under English law with developments in several other jurisdictions. It is argued that statutory reform is needed to achieve greater legal coherence and to provide a remedy that tracks the impact and severity of harm and is not confined to psychiatric disorders. A new legal framework is offered, rooted in reasonable foreseeability of mental or emotional harm, with a liability threshold of 'moderate severity'. To allay concerns about proliferating claims, modifications to the compensatory regime for personal injury are proposed 606 $aPersonal injuries 606 $2Torts / Delicts 606 $aLiability for emotional distress 606 $aNegligence$xLaw and legislation 606 $aDamages 615 0$aPersonal injuries. 615 0$aLiability for emotional distress. 615 0$aNegligence$xLaw and legislation. 615 0$aDamages. 676 $a346.4203 686 $a86.39$2bcl 700 $aTeff$b Harvey$0249550 801 0$bUtOrBLW 801 1$bUtOrBLW 801 2$bUkLoBP 906 $aBOOK 912 $a9910777722303321 996 $aCausing psychiatric and emotional harm$93763004 997 $aUNINA LEADER 02039nam0 22003491i 450 001 VAN00019127 005 20250227092114.409 010 $a88-464-0658-3 100 $a20040707d1998 |0itac50 ba 101 $aita 102 $aIT 105 $a|||| ||||| 181 $ai$b e 182 $an 200 1 $aMio figlio malato cronico$econsigli e suggerimenti per la famiglia e gli operatori$fPaola Catastini$gpresentazione di Gabriele Chiari 210 $aMilano$cAngeli$d1998 215 $a91 p.$d22 cm 330 $aPur senza false illusioni, sottolineando sempre quanto questi ragazzi debbano sostenere pesi psicologici pił grandi dei loro coetanei sani, l'autrice di questo libro, semplice e asciutto, accompagna genitori ed operatori nel loro vissuto quotidiano, fatto di dolori ma anche di gioie, di problemi legati all'etą, e di problemi - pił grandi - legati alla malattia. 410 1$1001VAN00283033$12001 $aSelf-help$1210 $aMilano$cAngeli$d1994-$v10 606 $aFanciulli infermi$xPsicologia$3VANC009410$2FI 620 $dMilano$3VANL000284 676 $a155.451$v21 700 1$aCatastini$bPaola$3VANV015276$0729256 712 $aFrancoAngeli $3VANV107955$4650 801 $aIT$bSOL$c20250228$gRICA 856 4 $uhttps://books.google.it/books?id=iQlKBRiOrq8C&printsec=frontcover&hl=it#v=onepage&q&f=false$zhttps://books.google.it/books?id=iQlKBRiOrq8C&printsec=frontcover&hl=it#v=onepage&q&f=false 856 4 $uhttps://www.francoangeli.it/Libro/Mio-figlio,-malato-cronico.-Consigli-e-suggerimenti-per-la-famiglia-e-gli-operatori?Id=4944$zhttps://www.francoangeli.it/Libro/Mio-figlio,-malato-cronico.-Consigli-e-suggerimenti-per-la-famiglia-e-gli-operatori?Id=4944 899 $aBIBLIOTECA DEL DIPARTIMENTO DI PSICOLOGIA$1IT-CE0119$2VAN16 912 $aVAN00019127 950 $aBIBLIOTECA DEL DIPARTIMENTO DI PSICOLOGIA$d16CONS 2092 $e16LET6482 20040707 996 $aMio figlio malato cronico$91429226 997 $aUNICAMPANIA
