However, neither common legally binding criteria for deciding the best jurisdiction nor specific rules for the transfer of proceedings (which can occur after parallel proceedings have been identified) were established in this instrument, or in any other instrument adopted by the EU to date. This book analyses the current EU legal framework on conflicts of jurisdiction and transfer of criminal proceedings, paying special attention to its numerous shortcomings and loopholes from a fundamental rights and due process of law perspective. The book begins with an assessment of the variousprinciples and grounds used by Member States for claiming criminal jurisdiction. Secondly, de lege lata EU procedure on the settlement of conflicts of criminal jurisdiction, as well as its implementation in Spain and Italy, are thoroughly examined. After discussing the main principles and fundamental rights at stake, the author proposes two alternative and original de lege ferenda models for the prevention and settlement of conflicts of criminal jurisdiction and transfer of criminal proceedings, exploring the different possibilities offered by the EU?s primary law. 410 0$aComparative, European and International Criminal Justice,$x2524-4566 ;$v3 606 $aLaw$zEurope 606 $aCriminal law$xInternational unification 606 $aCriminal law 606 $aConflict of laws 606 $aConflict of laws 606 $aInternational law 606 $aComparative law 606 $aEuropean Criminal Law 606 $aCriminal Law and Criminal Procedure Law 606 $aPrivate International Law, International and Foreign Law, Comparative Law 615 0$aLaw 615 0$aCriminal law$xInternational unification. 615 0$aCriminal law. 615 0$aConflict of laws. 615 0$aConflict of laws. 615 0$aInternational law. 615 0$aComparative law. 615 14$aEuropean Criminal Law. 615 24$aCriminal Law and Criminal Procedure Law. 615 24$aPrivate International Law, International and Foreign Law, Comparative Law. 676 $a340.9 700 $aHerna?ndez Lo?pez$b Alejandro$01268169 801 0$bMiAaPQ 801 1$bMiAaPQ 801 2$bMiAaPQ 912 $a9910632469103321 996 $aConflicts of Criminal Jurisdiction and Transfer of Proceedings in the EU$92982866 997 $aUNINA
