By means of a jurisprudential and comparative analysis, the book explores several issues created by the overruling of earlier decisions. Overruling of earlier decisions, when it occurs, operates retrospectively with the effect that it infringes the principle of legal certainty through upsetting any previous arrangements made by a party to a case under long standing precedents established previously by the courts. On this account, in the recent past, a number of jurisdictions have had to deal with the prospect of introducing in their own systems the well-established US practice of prospective overruling whereby the court may announce in advance that it will change the relevant rule or interpretation of the rule but only for future cases. However, adopting prospective overruling raises a series of issues mainly related to the constitutional limits of the judicial function coupled with the practical difficulties attendant upon such a practice. This book answers a number of the questions raised by this practice. It makes use of the great reservoir of foreign legal experience that furnishes theoretical and practical ideas from which national judges may draw their knowledge and inspiration in order to be able to advise a rational method of dealing with time when they give their decisions. 410 0$aIus Comparatum - Global Studies in Comparative Law,$x2214-6881 ;$v3 606 $aPrivate international law 606 $aConflict of laws 606 $aLaw?Philosophy 606 $aLaw 606 $aCriminal law 606 $aConstitutional law 606 $aPrivate International Law, International & Foreign Law, Comparative Law $3https://scigraph.springernature.com/ontologies/product-market-codes/R14002 606 $aTheories of Law, Philosophy of Law, Legal History$3https://scigraph.springernature.com/ontologies/product-market-codes/R11011 606 $aCriminal Law and Criminal Procedure Law$3https://scigraph.springernature.com/ontologies/product-market-codes/R13006 606 $aConstitutional Law$3https://scigraph.springernature.com/ontologies/product-market-codes/R17028 615 0$aPrivate international law. 615 0$aConflict of laws. 615 0$aLaw?Philosophy. 615 0$aLaw. 615 0$aCriminal law. 615 0$aConstitutional law. 615 14$aPrivate International Law, International & Foreign Law, Comparative Law . 615 24$aTheories of Law, Philosophy of Law, Legal History. 615 24$aCriminal Law and Criminal Procedure Law. 615 24$aConstitutional Law. 676 $a346.73032 700 $aSteiner$b Eva$4aut$4http://id.loc.gov/vocabulary/relators/aut$01224856 801 0$bMiAaPQ 801 1$bMiAaPQ 801 2$bMiAaPQ 906 $aBOOK 912 $a9910485025103321 996 $aComparing the Prospective Effect of Judicial Rulings Across Jurisdictions$92844019 997 $aUNINA
