Each contributor provides an answer on the basis of a careful analysis of the rules, assumptions and practices relating to their own national judicial system and legal culture. Written by national experts, the essays illustrate a variety of institutional designs towards a better reflection of the community. The involvement of lay people is often most visible in judicial appointments at senior court level, with political representatives sometimes appointing judges. They consider the lay involvement in the judicial system more widely, from the role of juries to the role of specialist lay judges and lay assessors in lower courts and tribunals. This lay input into judicial appointments is explored in light of the principle of judicial independence. The contributors also critically discuss the extent to which judicial action is legitimised by any ?democratic pedigree? of the judges or their decisions. The book thus offers a range of perspectives, all shaped by distinctive constitutional and legal cultures, on the thorny relationship between the principle of judicial independence and the idea of democratic accountability of the judiciary. 410 0$aIus Comparatum - Global Studies in Comparative Law,$x2214-6881 ;$v7 606 $aPrivate international law 606 $aConflict of laws 606 $aPolitical science 606 $aLaw?Philosophy 606 $aLaw 606 $aPrivate International Law, International & Foreign Law, Comparative Law $3https://scigraph.springernature.com/ontologies/product-market-codes/R14002 606 $aPhilosophy of Law$3https://scigraph.springernature.com/ontologies/product-market-codes/E27000 606 $aTheories of Law, Philosophy of Law, Legal History$3https://scigraph.springernature.com/ontologies/product-market-codes/R11011 615 0$aPrivate international law. 615 0$aConflict of laws. 615 0$aPolitical science. 615 0$aLaw?Philosophy. 615 0$aLaw. 615 14$aPrivate International Law, International & Foreign Law, Comparative Law . 615 24$aPhilosophy of Law. 615 24$aTheories of Law, Philosophy of Law, Legal History. 676 $a347.01 702 $aTurenne$b Sophie$4edt$4http://id.loc.gov/vocabulary/relators/edt 801 0$bMiAaPQ 801 1$bMiAaPQ 801 2$bMiAaPQ 906 $aBOOK 912 $a9910484859903321 996 $aFair Reflection of Society in Judicial Systems - A Comparative Study$92848341 997 $aUNINA
