This book follows the development of this crime of recruiting, conscripting or using children for participation in armed conflict, from human rights principle to fully fledged war crime, prosecuted at the International Criminal Court.   The background and reasons for the growing use of children in armed conflict are analysed, before discussing the origins of the crime in international humanitarian law and human rights law treaties, including the Convention on the Rights of the Child and its Optional Protocol. Specific focus is paid to the jurisprudence of the Special Court for Sierra Leone and the International Criminal Court in developing and expanding the elements of the crime, the modes of ascribing liability to perpetrators and the defences of mistake and negligence. The question of how the courts addressed issues of cultural sensitivity, notably in terms of the liability of children, is also addressed.  The book is a useful guide for practitioners dealing with the crime: the available defences and the ICC?s prosecutorial strategy. Dr. Julie McBride is currently working on international advocacy related to children and armed conflict at War Child Holland. The research for this book was carried out for Queen's University Belfast, T.M.C. Asser Instituut The Hague, and Colombia University New York. 606 $aInternational criminal law 606 $aHuman rights 606 $aInternational humanitarian law 606 $aPublic international law 606 $aInternational Criminal Law $3https://scigraph.springernature.com/ontologies/product-market-codes/R19040 606 $aHuman Rights$3https://scigraph.springernature.com/ontologies/product-market-codes/R19020 606 $aInternational Humanitarian Law, Law of Armed Conflict$3https://scigraph.springernature.com/ontologies/product-market-codes/R19030 606 $aPublic International Law $3https://scigraph.springernature.com/ontologies/product-market-codes/R19000 615 0$aInternational criminal law. 615 0$aHuman rights. 615 0$aInternational humanitarian law. 615 0$aPublic international law. 615 14$aInternational Criminal Law . 615 24$aHuman Rights. 615 24$aInternational Humanitarian Law, Law of Armed Conflict. 615 24$aPublic International Law . 676 $a341.6 676 $a341.67 700 $aMcBride$b Julie$4aut$4http://id.loc.gov/vocabulary/relators/aut$01224955 906 $aBOOK 912 $a9910484798003321 996 $aThe War Crime of Child Soldier Recruitment$92844221 997 $aUNINA
