Armed with hammers, they broke into military facilities to pound on missiles and pour blood on bombers, enacting the prophet Isaiah's vision: 'Nations shall beat their swords into plowshares and their spears into pruning hooks.' Calling themselves the Plowshares movement, these controversial activists received long prison sentences; nonetheless, their movement grew and expanded to Europe and Australia. In this book, Sharon Erickson Nepstad documents the emergence and international diffusion of this unique form of high-risk collective action. Drawing on interviews, original survey research, and archival data, Nepstad explains why some Plowshares groups have persisted over time while others have struggled or collapsed. L'empirisme de Locke, la modération de Montesquieu, le matérialisme d'Helvétius, l'esprit critique de l'Encyclopédie, l'égalitarisme de Rousseau : de fortes autorités philosophiques l'inspirent. En moins de cent pages, ce brûlot philosophique propose un nouveau paradigme pénal basé sur la modération des peines, leur utilité sociale et la sécularisation des crimes. Beccaria réclame la dépénalisation de l'homosexualité, alors réprimée comme un « crime contre nature ». Il estime que le suicide ne doit plus être poursuivi par la justice qui punit le pécheur révolté contre Dieu. Il juge que le vol résulte de l'inégale répartition des richesses. Il condamne la torture pour l'aveu du crime. Il veut remplacer les peines corporelles et flétrissantes par les travaux forcés et la prison correctrice. Il prône l'abolition de la peine de mort pour les crimes de droit commun. L'humanisme pénal de Beccaria n'a rien perdu de son actualité. Commenté dans toute l'Europe, mis à l'Index romain, fustigé par les juristes hostiles aux Lumières, loué par Voltaire, inspirant partiellement les législateurs révolutionnaires et le réformisme carcéral des philanthropes de la Restauration, critiqué ou loué par les juristes et les criminologues positivistes durant le long XIXe siècle, l'ouvrage de Beccaria suscite une controverse pénale, bien vivante aujourd'hui en Chine ou dans le droit pénal européen et international.
