Conclusion. 330 $aThis book presents a creative synthesis of two ostensibly disparate fields of law ? arbitration and human rights. More specifically, it focuses on various legislative approaches to excluding the annulment of arbitral awards (setting-aside proceedings) at the seat of arbitration and evaluates the compatibility of such approaches with the European Convention on Human Rights (ECHR), in particular the right to a fair trial under Article 6(1). The book first assesses the applicability and impact of the ECHR, in particular Article 6(1), on international commercial arbitration. It then analyses a number of legislative approaches to excluding setting-aside proceedings, focusing on two synergetic phenomena ? exclusion agreements and the total lack of setting-aside proceedings in national arbitration law. Lastly, the book investigates to what extent the lack of setting-aside proceedings in national arbitration law may lead to a violation of arbitrating parties? right to a fair trial under Article 6(1), and puts forward certain de lege ferenda recommendations on how to best approach the regulation of setting-aside proceedings in national arbitration law from the standpoint of compliance with the ECHR. 606 $aMediation 606 $aDispute resolution (Law) 606 $aConflict management 606 $aHuman rights 606 $aCivil rights 606 $aConflict of laws 606 $aConflict of laws 606 $aDispute Resolution, Mediation, Arbitration$3https://scigraph.springernature.com/ontologies/product-market-codes/R22000 606 $aHuman Rights$3https://scigraph.springernature.com/ontologies/product-market-codes/R19020 606 $aEuropean Fundamental Rights and Freedoms$3https://scigraph.springernature.com/ontologies/product-market-codes/R20010 606 $aPrivate International Law, International & Foreign Law, Comparative Law $3https://scigraph.springernature.com/ontologies/product-market-codes/R14002 615 0$aMediation. 615 0$aDispute resolution (Law) 615 0$aConflict management. 615 0$aHuman rights. 615 0$aCivil rights. 615 0$aConflict of laws. 615 0$aConflict of laws. 615 14$aDispute Resolution, Mediation, Arbitration. 615 24$aHuman Rights. 615 24$aEuropean Fundamental Rights and Freedoms. 615 24$aPrivate International Law, International & Foreign Law, Comparative Law . 676 $a341.481 700 $aKr?mi??$b Toms$4aut$4http://id.loc.gov/vocabulary/relators/aut$0883065 801 0$bMiAaPQ 801 1$bMiAaPQ 801 2$bMiAaPQ 906 $aBOOK 912 $a9910416143903321 996 $aArbitration and Human Rights$91972532 997 $aUNINA
