More specifically, it focuses on the extent of French influence ? among others ? in European and American civil law jurisdictions. In this regard, the book seeks to dispel a number of myths concerning the French model?s actual influence on European and Latin American criminal codes. The impact of the Napoleonic criminal code on other jurisdictions was real, but the scope and extent of its influence were significantly less than has sometimes been claimed. The overemphasis on French influence on other civil law jurisdictions is partly due to a fundamental assumption that modern criminal codes constituted a break with the past. The question as to whether they truly broke with the past or were merely a degree of reform touches on a difficult issue, namely, the dichotomy between tradition and foreign influences in the codification of criminal law. Scholarship has unfairly ignored this important subject, an oversight that this book remedies. 410 0$aStudies in the History of Law and Justice,$x2198-9850 ;$v11 606 $aCriminal law 606 $aCriminology 606 $aLaw$xHistory 606 $aConflict of laws 606 $aConflict of laws 606 $aInternational law 606 $aComparative law 606 $aCriminal Law and Criminal Procedure Law 606 $aCriminology 606 $aLegal History 606 $aPrivate International Law, International and Foreign Law, Comparative Law 615 0$aCriminal law. 615 0$aCriminology. 615 0$aLaw$xHistory. 615 0$aConflict of laws. 615 0$aConflict of laws. 615 0$aInternational law. 615 0$aComparative law. 615 14$aCriminal Law and Criminal Procedure Law. 615 24$aCriminology. 615 24$aLegal History. 615 24$aPrivate International Law, International and Foreign Law, Comparative Law. 676 $a345.0072 702 $aMasferrer$b Aniceto$f1971-$4edt$4http://id.loc.gov/vocabulary/relators/edt 906 $aBOOK 912 $a9910300050203321 996 $aThe Western Codification of Criminal Law$92007716 997 $aUNINA
