The underlying thesis is that the joint membership of the EU and its Member States is fallacious, in that it could cause the EU to become responsible for violations of the WTO regulations on the part of the Member States. Such fallacies are rooted in the blurred nature of the distribution of powers in the EU polity. In order to tackle the issue of international responsibility, the analysis is based on the facts of a real-world case. Based on the tenets of public international law, the law of mixed agreements and the EU constitutional principles, the book puts forward a model for the EU?s participation in the DSP, and for the reallocation of burdens to the respective responsible entity. This proposition deconstructs the joint responsibility regime and endorses a solution that could address the issue of responsibility in mixed agreements without a declaration of powers. 606 $aLaw?Europe 606 $aInternational law 606 $aTrade 606 $aMediation 606 $aDispute resolution (Law) 606 $aConflict management 606 $aEuropean Economic Community literature 606 $aInternational organization 606 $aEuropean Law$3https://scigraph.springernature.com/ontologies/product-market-codes/R20000 606 $aInternational Economic Law, Trade Law$3https://scigraph.springernature.com/ontologies/product-market-codes/R19050 606 $aDispute Resolution, Mediation, Arbitration$3https://scigraph.springernature.com/ontologies/product-market-codes/R22000 606 $aSources and Subjects of International Law, International Organizations$3https://scigraph.springernature.com/ontologies/product-market-codes/R19010 606 $aEuropean Integration$3https://scigraph.springernature.com/ontologies/product-market-codes/W33010 606 $aInternational Organization$3https://scigraph.springernature.com/ontologies/product-market-codes/912010 615 0$aLaw?Europe. 615 0$aInternational law. 615 0$aTrade. 615 0$aMediation. 615 0$aDispute resolution (Law). 615 0$aConflict management. 615 0$aEuropean Economic Community literature. 615 0$aInternational organization. 615 14$aEuropean Law. 615 24$aInternational Economic Law, Trade Law. 615 24$aDispute Resolution, Mediation, Arbitration. 615 24$aSources and Subjects of International Law, International Organizations. 615 24$aEuropean Integration. 615 24$aInternational Organization. 676 $a341.2422 700 $aRuka$b Plarent$4aut$4http://id.loc.gov/vocabulary/relators/aut$0903268 906 $aBOOK 912 $a9910255276803321 996 $aInternational Legal Responsibility of the European Union in the Context of the World Trade Organization in Areas of Non-Conferred Competences$92983634 997 $aUNINA
