To address that gap, it proposes the creation of benchmarks of legislative activity, reasoning that EU secondary legislation, such as directives and regulations, should be based on higher sources of law. It investigates two such possible sources: the activity of the EU Court of Justice in the pre-legislative era and the EU treaties. From these sources, the author establishes concrete benchmarks of legislative activity, which she then tests by applying them to current EU copyright legislation. This provides examples of good and bad practices in copyright lawmaking and also shows how the benchmarks could be implemented in copyright legislation. Finally, the author offers some recommendations in this regard. 606 $aMass media 606 $aLaw 606 $aLaw?Europe 606 $aEuropean Economic Community literature 606 $aEuropean Union 606 $aIT Law, Media Law, Intellectual Property$3https://scigraph.springernature.com/ontologies/product-market-codes/R15009 606 $aEuropean Law$3https://scigraph.springernature.com/ontologies/product-market-codes/R20000 606 $aEuropean Integration$3https://scigraph.springernature.com/ontologies/product-market-codes/W33010 606 $aEuropean Union Politics$3https://scigraph.springernature.com/ontologies/product-market-codes/911140 615 0$aMass media. 615 0$aLaw. 615 0$aLaw?Europe. 615 0$aEuropean Economic Community literature. 615 0$aEuropean Union. 615 14$aIT Law, Media Law, Intellectual Property. 615 24$aEuropean Law. 615 24$aEuropean Integration. 615 24$aEuropean Union Politics. 676 $a340 700 $aRamalho$b Ana$4aut$4http://id.loc.gov/vocabulary/relators/aut$01059508 906 $aBOOK 912 $a9910255199403321 996 $aThe Competence of the European Union in Copyright Lawmaking$92506734 997 $aUNINA
