Pour comprendre cette loi, il est d'abord nécessaire de la replacer dans un contexte particulier pour l'enseignement supérieur. Comment le pouvoir gaulliste a-t-il fait face au défi de la massification des étudiants dans les années soixante ? Des projets de réforme ont existé avant la loi Faure mais ils n'apportaient que des solutions conjoncturelles aux problèmes soulevés et aucun n'a eu cette volonté de structuration présente dans la loi Faure. Les événements de 1968 ont cristallisé les interrogations, y compris au plus haut niveau de l'État entre Charles De Gaulle et Georges Pompidou, notamment sur des sujets aussi sensibles que la sélection à l'entrée des formations. L'examen de cette loi « libérale » constitue le second temps de cette analyse : préparation rapide du projet dans un cabinet ministériel en pleine ébullition, débats au Parlement, réactions d'opposition des étudiants de droite. Tout cela aboutit finalement à une loi peu ou mal appliquée, compte-tenu de la réaction des syndicats enseignants, de la mise en ?uvre difficile dans les établissements, à Nanterre par exemple, ou encore des difficultés à faire respecter la nouvelle autonomie des universités. Les conclusions auxquelles sont parvenus les auteurs sont paradoxales : on est passé de l'Université aux universités ? en regroupant les facultés ? en dérogeant aussi parfois à la loi même ? par la création d'universités de technologie.
