Dignity and Responsibility in South African Law --$tConclusion --$tNotes --$tIndex 330 $aA major American legal thinker, the late Ronald Dworkin also helped shape new dispensations in the Global South. In South Africa, in particular, his work has been fiercely debated in the context of one of the world?s most progressive constitutions. Despite Dworkin?s discomfort with that document?s enshrinement of ?socioeconomic rights,? his work enables an important defense of a jurisprudence premised on justice, rather than on legitimacy. Beginning with a critical overview of Dworkin?s work culminating in his two principles of dignity, Cornell and Friedman turn to Kant and Hegel for an approach better able to ground the principles of dignity Dworkin advocates. Framed thus, Dworkin?s challenge to legal positivism enables a theory of constitutional revolution in which existing legal structures are transformatively revalued according to ethical mandates. By founding law on dignity, Dworkin begins to articulate an ethical jurisprudence responsive to the lived experience of injustice. This book, then, articulates a revolutionary constitutionalism crucial to the struggle for decolonization. 410 0$aJust Ideas (FUP) 606 $aConstitutional law$xSouth Africa 606 $aConstitutional law$zSouth Africa 606 $aDignity 606 $aSocial justice$xSouth Africa 606 $aSocial justice$zSouth Africa 610 $aRevolution. 610 $aRonald Dworkin. 610 $aSouth Africa. 610 $aconstitutionalism. 610 $acritical idealism. 610 $ajurisprudence. 615 0$aConstitutional law$xSouth Africa. 615 0$aConstitutional law 615 0$aDignity. 615 0$aSocial justice$xSouth Africa. 615 0$aSocial justice 676 $a342.001 700 $aCornell$b Drucilla$4aut$4http://id.loc.gov/vocabulary/relators/aut$0162088 702 $aFriedman$b Nick$4aut$4http://id.loc.gov/vocabulary/relators/aut 801 0$bDE-B1597 801 1$bDE-B1597 906 $aBOOK 912 $a9910798419803321 996 $aThe Mandate of Dignity$93730161 997 $aUNINA LEADER 02309oas 2200889 a 450 001 9910139475503321 005 20250922213015.0 035 $a(OCoLC)650509280 035 $a(CONSER) 2010202064 035 $a(CKB)2550000000015548 035 $a(DE-599)ZDB2572216-5 035 $a(EXLCZ)992550000000015548 100 $a20100728a20109999 sy a 101 0 $aeng 135 $aur||||||||||| 181 $ctxt$2rdacontent 182 $cc$2rdamedia 183 $acr$2rdacarrier 200 00$aBiomedical optics express 210 $aWashington, DC $cOptical Society of America 215 $a1 online resource 300 $aRefereed/Peer-reviewed 311 08$a2156-7085 517 1 $aBOE 531 0 $aBiomed. opt. express 606 $aImaging systems in medicine$vPeriodicals 606 $aDiagnostic imaging$vPeriodicals 606 $aOptical tomography$vPeriodicals 606 $aDiagnostic Imaging 606 $aTomography, Optical 606 $aDiagnostic imaging$2fast$3(OCoLC)fst00892354 606 $aImaging systems in medicine$2fast$3(OCoLC)fst00967628 606 $aOptical tomography$2fast$3(OCoLC)fst01046815 608 $aPeriodical. 608 $aFulltext. 608 $aInternet Resources. 608 $aPeriodicals. 608 $aPeriodicals.$2fast 615 0$aImaging systems in medicine 615 0$aDiagnostic imaging 615 0$aOptical tomography 615 12$aDiagnostic Imaging. 615 22$aTomography, Optical. 615 7$aDiagnostic imaging. 615 7$aImaging systems in medicine. 615 7$aOptical tomography. 676 $a616 712 02$aOptical Society of America. 801 0$bDLC 801 1$bDLC 801 2$bDLC 801 2$bHEBIS 801 2$bHNK 801 2$bNLM 801 2$bBUF 801 2$bDLC 801 2$bUMC 801 2$bOCLCQ 801 2$bOCLCF 801 2$bCUS 801 2$bOCLCQ 801 2$bDLC 801 2$bOCLCQ 801 2$bCASUM 801 2$bOCLCA 801 2$bDLC 801 2$bAU@ 801 2$bOCLCO 801 2$bOCLCA 801 2$bBWN 801 2$bOCLCQ 801 2$bAUD 801 2$bOCLCL 906 $aJOURNAL 912 $a9910139475503321 996 $aBiomedical optics express$92128517 997 $aUNINA
