Per anni ciò è stato contestato dal punto di vista del diritto del lavoro, ma con una certa tendenza a negarlo. Tuttavia, nel dicembre 2020 il BAG ha stabilito che un crowd worker può essere un dipendente in generale. Quindi, come vanno valutate le circostanze che fanno di un crowd worker un dipendente (o non dipendente)? Questo è ciò che questo documento indaga.Nella prima parte del paper, esaminiamo vari studi empirici sul crowd work e analizziamo il funzionamento delle piattaforme. Viene considerata anche la sociologia economica e organizzativa. Nella seconda parte vengono presentate analisi di casi concreti da un auto-esperimento per poterli valutare in termini di diritto del lavoro. Nella terza parte si aprono due aspetti, in primo luogo come la divergenza tra la nozione giuridica nazionale ed europea di lavoratore dipendente si riveli nuovamente nel crowd work. D'altra parte, vengono suggerite nuove forme di regolamentazione: ad esempio, il regolamento P2B (2019/1150) non si adatta a molti dei problemi del lavoro in piattaforma? E la sua applicabilità al lavoro su piattaforma? Che dire della "regolazione in base alla progettazione"?
