On s’inquiète de sa responsabilité ; on veut connaître scs opinions. On suppose son pouvoir, ou on déplore qu’elle n’en ait aucun. Chaque fois, le singulier s’impose et désigne un « corps de magistrats » doté, par la magie évocatrice de l’unité supposée, d’une puissance et d’une majesté que la justice entretient visiblement jusque dans ses temples et ses atours. Un singulier qui résonne plus fort encore lorsqu’il s’agit de l’opposer, tels deux blocs antagonistes, au pouvoir politique. Monde judiciaire, ordre judiciaire, autorité ou pouvoir judiciaire : la conflictualité qui marque les rapports entre « le » pouvoir juridictionnel et « le » politique s’embarrasse rarement des nuances constitutives du corps divers de la magistrature. Pourtant, l’unité doit-elle suivre ce singulier d’usage ? A l’image d’un monde complexe, la magistrature est bien traversée de divisions sociales et d’une pluralité de représentations et d’habitudes mentales. La variété des statuts de ses membres, les blocages hiérarchiques - propres au moins à tout système administratif - les résistances entre magistrats supérieurs et inférieurs, les conflits de compétence ou de juridiction, les rivalités entre « le » siège et « le » parquet, l’cclatcmcnt des ordres juridictionnels, le pluralisme syndical, les parcours politiques individuels : tout invite à se méfier d’un singulier forcément trompeur, porteur de représentations conventionnelles, et à explorer, en complément, les diversités de la magistrature.
