WomenPolitical activityQuébec (Province)French-Canadian lettersQuébec (Province)History and criticismFrench-Canadian letters19th centuryHistory and criticismFrench-Canadian lettersWomen authorsHistory and criticismQuébec (Province)Intellectual life19th centuryWomenPolitical activityFrench-Canadian lettersHistory and criticism.French-Canadian lettersHistory and criticism.French-Canadian lettersWomen authorsHistory and criticism.305.4209714Bédard Mylène969341MiAaPQMiAaPQMiAaPQBOOK9910495846703321Écrire en temps d'insurrections2202747UNINA03653nam 22007091 450 991097285640332120251211121126.01-4725-6271-21-280-80789-X97866108078951-84731-045-110.5040/9781472562715(CKB)1000000000338582(EBL)270736(OCoLC)476005141(SSID)ssj0000177293(PQKBManifestationID)12072675(PQKBTitleCode)TC0000177293(PQKBWorkID)10210701(PQKB)10136125(Au-PeEL)EBL1772504(CaPaEBR)ebr10276045(CaONFJC)MIL80789(OCoLC)893332122(OCoLC)1057397511(UtOrBLW)bpp09256365(Au-PeEL)EBL270736(OCoLC)191746282(MiAaPQ)EBC1772504(MiAaPQ)EBC270736(EXLCZ)99100000000033858220140929d2003 uy 0engur|n|---|||||txtccrImporting the law in post-communist transitions the Hungarian Constitutional Court and the right to human dignity /Catherine Dupre1st ed.Oxford ;Portland, Oregon :Hart Publishing,2003.1 online resource (238 p.)Human rights law in perspective ;v. 1Description based upon print version of record.1-84113-131-8 Includes bibliographical references (pages [193]-209) and index.New constitutions after communism -- The importation of law -- Importing human dignity from German law -- Choosing the right model -- Instrumentalising the model -- Overcoming the communist legacy -- Imported law : between natural law and globalisation."This book, one of the very first monographs on the Hungarian Constitutional Court available in English, is a unique study of the birth of a new legal system after the collapse of communism in Central and Eastern Europe. It shows that the genesis of the new legal order was determined by massive Western involvement and an unprecedented movement of export/import of law. Anchored in a detailed comparative study of German and Hungarian constitutional case law on human dignity, this book argues that law importation was a deliberate strategy carried out by the Hungarian Court in the early years of its operation. It explains how the circumstances of the transition and the background of the importers determined the choice of German case law as a model and how the Court used it to construct its own version of the right to human dignity. It highlight the Hungarian Court's instrumentalisation of imported law in order to lay the foundations of a new conception of fundamental rights. While focusing on the Hungarian experience, this book engages with international debates and provides an original theoretical framework for approaching the movement of law from the importers' perspective."--Bloomsbury Publishing.Human rights law in perspective ;v. 1.Civil rightsGermanyCivil rightsHungaryConstitutional courtsHungaryCivil rightsCivil rightsConstitutional courts347.439/01Dupré Catherine1969-386999UtOrBLWUtOrBLWBOOK9910972856403321Importing the law in post-communist transitions4480401UNINA
