Lo sviluppo e la maturazione di quest'opera sono stati piuttosto tortuosi e complessi, e sono il risultato di un percorso iniziato nel 1978 e portato avanti attraverso tappe complesse e faticose. La sua entrata in vigore rappresenta un cambiamento epocale nella storia giuridica mondiale, poiché con essa la Cina, che già da tempo manifestava la sua adesione al sistema giuridico romano, entra definitivamente a far parte degli ordinamenti giuridici del diritto codificato. Il volume raccoglie gli atti di una Summer school organizzata nel 2019 dai prof. Maurizio Onza e Antonio Saccoccio presso l'Università di Brescia, con la partecipazione di studenti e docenti italiani e cinesi. Alcuni studiosi italiani e cinesi, di diversa formazione e appartenenti a diversi settori del diritto e dell'economia, sono stati così chiamati a riflettere sui contenuti del Codice, che all'epoca era in una fase molto avanzata di preparazione, pur non essendo ancora entrato in vigore.
