La structure de la société et de l'habitat – un monde de maisons et de familles coagulées dans leurs privilèges – ajoutée à la faiblesse régionale des pouvoirs souverains, expliquait un maintien tardif des procédures d'apaisement dans la répression des crimes. La pacification l'emportait alors sur les enquêtes et l'affliction des peines, coercitions réservées à une minorité d'affaires. Toutefois, au XVe siècle, une épiphanie justicière vint heurter ces usages si anciens dont « personne n'avait plus mémoire du contraire ». Pratiques inquisitoires, traques de criminels, procédures d'office et tortures judiciaires s'abattirent sur des populations qui continuaient à proclamer leurs anciennes coutumes comme garantes des équités ancestrales. L'exercice de la justice devint un défi peuplé de discours frénétiques, de fers, d'entreprises autoritaires, de tyrannies d'exercice, de grâce souveraine et de contestations communautaires. À l'issue de la guerre de Cent Ans, la conquête judiciaire ajustait la Gascogne aux rigueurs et aux miséricordes venues de France. Vivacité des traditions et exigences de la souveraineté triomphante se mêlèrent alors en une surprenante acculturation pénale dépossédant partiellement les communautés de leurs protections coutumières.
