Long description: Die Diskussion um möglicherweise manipulierte Krankenhausabrechnungen hat in jüngster Zeit, nicht zuletzt durch die Berichterstattung in diversen Medien, an Schärfe gewonnen. Nach einer Darstellung der Rechtsverhältnisse im System der Gesetzlichen Krankenversicherung, der Entwicklung der Krankenhausfinanzierung und der Grundlagen des G-DRG-Systems beschäftigt sich Janika Sievert umfassend mit der Frage, ob und in welchen Konstellationen vor allem das Upcoding unter den Tatbestand des Betruges zu subsumieren ist. Ein erster Schwerpunkt liegt dabei auf dem bislang wenig diskutierten Irrtum innerhalb arbeitsteilig organisierter juristischer Personen. Sodann wird die Prüfung des Vermögensschadens eingehend erörtert, wobei die streng formale Betrachtungsweise des Sozialrechts und ihre Anwendung auf Abrechnungsbetrug durch Krankenhäuser besonders herausgestellt wird. Des Weiteren diskutiert die Autorin die Amtsträgereigenschaft von Ärzten und gelangt zu dem Ergebnis, dass hierfür nach der Trägerschaft der sie beschäftigenden Krankenhäuser zu differenzieren ist. Nach einer ausführlichen Prüfung der strafrechtlichen Relevanz des Upcodings werden auch die Manipulationsformen Downcoding und das Abrechnen einer nicht notwendigen Leistung einer strafrechtlichen Würdigung unterzogen. |
