• Sommario/riassunto: Long description: Der Band versammelt Aufsätze des Autors zur Geschichte der Rechtswissenschaft, insbesondere der Rechtsgeschichte des 18. bis 20. Jahrhunderts. Hauptthema ist die langandauernde wissenschaftliche Fruchtbarkeit der deutschen Historischen Rechtsschule, deren Ansätze von den juristischen Germanisten auch in die Verfassungsgeschichte und das Verfassungsrecht eingeführt werden. In einer neuen Einführung wird diese Fruchtbarkeit aus dem von F. K. von Savigny programmatisch begründeten Spannungsverhältnis von romantischen Elementen (Volksgeist) und der von ihm ebenfalls herausgestellten überzeitlichen Rationalität des Römischen Rechts hergeleitet. Im Zentrum stehen Analysen der Werke von Otto von Gierke und Max Weber. Am Ende wird die Weiterführung durch deutsch-jüdische Emigranten in den USA beleuchtet, die zur Entwicklung eines neuen Mittelalterbildes beitragen.
