Die Bedeutung der Rechtsphilosophie ist durch die Anwendung der Radbruchschen Formel aktuell und praktisch geworden. Die Beziehungen zwischen der Strafrechtswissenschaft und der Rechtsphilosophie sind seit langem sehr intensiv, was sich etwa an den von Strafrechtlern verfaßten Lehrbüchern der Rechtsphilosophie zeigt. Gegenstand der rechtsphilosophisch arbeitenden Strafrechtswissenschaftler ist zum einen die Rechtfertigung der Strafe, die sog. »Strafphilosophie«. Zum anderen geht es um die Legitimierung freiheitseingreifender Strafgesetze zum Schutze der Freiheit, sog. »Strafrechtsphilosophie«. Schließlich wird auch in der Strafrechtsdogmatik rechtsphilosophisch argumentiert, z.B. wenn es um Freiheit und Solidarität bei der Begründung von Hilfs- und Duldungspflichten geht (§§ 323c, 34 StGB). |
