Der EuGH hat mit seiner Rechtsprechung die soziale Dimension der europäischen Integration wesentlich beeinflusst - durch viele Entscheidungen zur Freizügigkeit und zur Dienstleistungsfreiheit, zum koordinierenden Sozialrecht, zum Arbeitsrecht, Arbeitsschutz und zur Gleichstellung. Er hat soziale Rechte entfaltet, sie zum Teil ausgeweitet, ihre Eingebundenheit in wirtschaftliche Freiheiten betont. Damit ist er auf Zustimmung, aber auch auf teilweise sehr deutliche Kritik gestoßen.Der vorliegende Tagungsband soll die Entwicklung des europäischen Arbeits- und Sozialrechts nachzeichnen, kritisch untersuchen und einem möglichst großen Kreis von Interessierten zugänglich machen. Zugleich soll er die weitere Diskussion über die Zukunft des Sozialen Europa im Wechselspiel zwischen Politik und Rechtsprechung anstoßen.
