• Sommario/riassunto: Hegels Philosophie des objektiven Geistes hat nach wie vor große Bedeutung für die praktische Philosophie und die Rechtsphilosophie der Gegenwart. Von der „Rehabilitierung der praktischen Philosophie“ im letzten Drittel des 20. Jahrhunderts über die neuen Ansätze einer „Sozialpathologie“ in der Frankfurter Schule bis zu der neopragmatistischen Hegel-Renaissance in den USA lässt sich diese Wirkung verfolgen. Bis heute wenig geklärt ist aber, wie Hegel selber den Begriff und die Epoche der Moderne versteht. Umstritten ist auch, wie weit Hegel dem „Projekt der Moderne“ (Habermas), d.h. zentralen Forderungen der Rechts- und Staatsphilosophie seit der Aufklärung, verpflichtet ist. Das wird in diesem Text an folgenden ausgewählten Fragen untersucht: der Problematik von Grundrechten und staatlicher Souveränität, bürgerlicher Marktgesellschaft und den Anfängen des Sozialstaates sowie dem Verhältnis von Staat und Religion. Dabei erweist sich, dass die Philosophie Hegels einerseits mit wesentlichen ; Forderungen der Moderne übereinstimmt. Auf der anderen Seite bleiben ihm – anders als viele seiner heutigen Interpreten meinen – wichtige „moderne“ Entwicklungen verschlossen, vor allem auf dem Gebiet der Rechtsstaatlichkeit, der Souveränitätsbeschränkung und des weltanschaulichen Pluralismus.
