Die Arbeitgeberverbände entwickelten bereits in den 1990er-Jahren das Modell der Mitgliedschaft ohne Tarifbindung (OT-Mitgliedschaft), da immer mehr Arbeitgeber beklagten, dass Flächentarifverträge zu unflexibel und starr für den eigenen Betrieb seien. Als Alternative zum vollständigen Verbandsaustritt bietet die OT-Mitgliedschaft sowohl für den Verband als auch für den einzelnen Arbeitgeber mehrere Vorteile. Um gleichzeitig die Funktionsfähigkeit der Tarifautonomie zu wahren, muss die Satzung bestimmten von der Rechtsprechung entwickelten Anforderungen genügen. Besonders interessant wird es, wenn sich der einzelne Arbeitgeber während laufender Tarifverhandlungen dazu entscheidet, den Verband zu verlassen oder in die OT-Mitgliedschaft zu wechseln. Problematisch wird die Situation für den einzelnen Arbeitgeber, wenn der Wechsel in die OT-Mitgliedschaft sich nachträglich als unwirksam herausstellt. Dann stellt sich die Frage nach internen Haftungsansprüchen gegen den Verband. |
