Das Werk befasst sich mit den Haftungsfragen beim dem Einsatz des Hydraulic Fracturing-Verfahrens (Fracking). Nach einer einleitenden Darstellung der technischen Ablaufe, der aktuell diskutierten Risiken beim Einsatz von Frackings und dem bestehenden Genehmigungsrahmen werden sowohl Tatbestande der Gefahrdungshaftung, als auch der Verschuldenshaftung untersucht, sowie Ausgleichsanspruche. Einen Schwerpunkt der Untersuchung bilden dabei Tatbestande, die eine Gefahrdungshaftung normieren. Vertieft untersucht wird in diesem Zusammenhang, ob und in welchem Umfang eine Haftung fur Schaden infolge Frackings auf der Grundlage von 114 ff. Bundesberggesetz (BBergG) begrundet werden kann. Daruber hinaus untersucht wird eine Haftung nach 89 WHG, 1 UmweltHG sowie nach 823 BGB. Der Verfasser ist Rechtsanwalt im Dusseldorfer Buro einer internationalen Sozietat und berat schwerpunktmassig Unternehmen der Energiewirtschaft. |
