D'éminents juristes, praticiens et théoriciens du droit, canadiens et européens, étaient invités à examiner l'évolution des politiques pénales dans nos démocraties, et à faire le point sur quelques-uns des problèmes, en amont ou en aval, entraînés par l'alourdissement des peines, les transformations encourues, un peu partout, par le droit pénal et le processus, généralisé à l'échelle des démocraties occidentales, de « tolérance zéro » en matière des « crimes et châtiments ». La dérive punitive qui sévit à l’heure actuelle de part et d’autre de l’Atlantique, menace-t-elle le droit de punir en démocratie, voire la démocratie elle-même ? Surtout depuis le 11 septembre 2001, se développe une société de surveillance, qui s'accompagne d'un glissement du droit pénal allant de la réaction à l’infraction commise à la prévention de l’infraction appréhendée, de la criminalisation d’actes autrefois neutres et de l’augmentation de la population carcérale. La durée et la proportion excessives des détentions préventives, la notion de dangerosité entraînant des peines indéfinies, les détentions sans mandat de plus en plus longues en vertu de mesures antiterroristes sont des exemples qui soulèvent d’épineuses questions de protection des droits de la personne.
