Il requisito di creatività, quale condicio sine qua non per l’accesso alla protezione secondo il diritto d’autore, sconta una marcata ambiguità interpretativa ed applicativa che riflette le eterogenee sensibilità giurisprudenziali in merito a quale significato attribuire ad una clausola generale le cui radici etimologiche affondano in contesti extra-giuridici. Ai dubbi esegetici già da tempo gravitanti intorno ad un concetto così etereo ed evolutivo si è affiancato più di recente l’incerto ruolo degli interessi alla remunerazione degli investimenti, specialmente quelli diretti a stimolare la costituzione di Big Data e la produzione di contenuti mediante Intelligenza Artificiale, nonché le disomogenee attenzioni ai susseguenti effetti (pro e anti) concorrenziali. Essi costituiscono le cause determinanti la multiforme nebulosità delle derive della creatività del diritto d’autore nella realtà tecnologica contemporanea. La messa a fuoco di ciascun interesse e la mappatura delle loro intersezioni nel corso della valutazione di tutelabilità autoriale aspira a proporre delle coordinate ermeneutiche più puntuali di quanto sia stato suggerito sino ad ora. Ed in questo senso si ambisce a ricondurre le menzionate derive della creatività autoriale nei binari della sostenibilità, nel rispetto del target 8.3 dell’Agenda ONU 2030. |
