The thesis examines the question of the extent to which premiums, contractual and association penalties constitute compensable damages or inadmissible legal transactions to the detriment of third parties. Die Arbeit setzt sich mit der Frage auseinander, inwiefern private Schadensgestaltungen wie Fangprämien, Vertrags- und Verbandsstrafen regressfähige Schadensposten oder unzulässige Rechtsgeschäfte zu Lasten Dritter darstellen. Allein schadensrechtliche Mechanismen schützen den Dritten nur unzureichend vor rechtsgeschäftlichen Belastungen. Aus diesem Grund ist eine vorgelagerte Kontrolle des Rechtsgeschäfts notwendig. Daran anknüpfend setzt sich die Arbeit kritisch mit den bisherigen Abhandlungen zu drittbelastenden Rechtsgeschäften allgemein auseinander und unterbreitet dazu einen neuen Ansatz. Diesen zugrunde gelegt, stellen sich die untersuchten privaten Schadensgestaltungen als unverhältnismäßige Rechtsgeschäfte zu Lasten Dritter dar, die in der Folge relativ unwirksam sind. Da sie somit keine Wirkung gegenüber Dritten entfalten, verkörpern sie auch keinen ersatzfähigen Schadensposten der Geschädigten (also der Vereine, Ladeninhaber oder Hauptunternehmer). |
