Long description: Im Rahmen der Föderalismusreform I wurde im Herbst 2006 mit der Abweichungsgesetzgebung der Bundesländer bei bestimmten Kompetenztiteln und im Verfahrensrecht ein neues Gesetzgebungsinstrument eingeführt.  Es soll dazu beitragen, die Gesetzgebung von Bund und  Ländern zu stärken, Blockaden im Bundesratsverfahren abzubauen sowie die Europatauglichkeit des Grundgesetzes zu verbessern.  Beim Erlass der Regelungen war man sich klar darüber, dass hier ein Experimentierspielraum hin zu einem Konkurrenzföderalismus eröffnet wurde. Wie weit die gesetzten Ziele erreicht werden ,zumindest jedoch Fortschritte erzielt werden können, muss sich in der Gesetzgebungspraxis erweisen. Die Hoffnung, dass dies möglich sein wird,ist jedoch durchaus berechtigt. Klar ist aber auch, dass die Reform ähnlich wie vorherige nur eine Zwischenstation sein  kann; die Anpassung des Staates an die Veränderung der Rahmenbedingungen, die auch durch den europäischen Entwicklungsprozess beeinflusst werden, ist eine immerwährende Aufgabe.
