La "incapacitación judicial" (o "modificación de la capacidad de obrar") es un procedimiento que habitualmente afrontan personas a las que se ha diagnosticado discapacidad intelectual. Esta práctica se realiza para establecer medidas judiciales de protección personal y patrimonial. Sin embargo, este procedimiento implica la vulneración de derechos



fundamentales. Los relatos de las experiencias vividas por personas afectadas y sus familiares sugieren que esta práctica está profundamente atravesada por un conjunto de prejuicios, estigmas y estereotipos sobre las personas a las que se ha diagnosticado discapacidad intelectual. Desde la perspectiva de la antropología jurídica y los Critical Disability Studies, se ofrece un análisis cualitativo sobre esta cuestión.
