"Impeachment of witnesses is "an alien, mystifying, and obtuse area of the law," write the authors of MacCarthy on Impeachment. While there are many books on evidence and trial advocacy, there is very little written specifically on impeachment. For the trial lawyer and judge, it is one of the most confusing and misunderstood parts of the trial. Just as cross examination is the most difficult of trial skills, impeachment, usually a part of cross examination, is the most difficult of the difficult. Many, if not most, trial lawyers do not know what they can or cannot do to impeach. Most importantly, they do not know how to do what they can do.
