Anhand der Rechtslast können letzte Zweifel eines Gerichts in Rechtsfragen im Wesentlichen ebenso behandelt werden wie letzte Zweifel in Tatsachenfragen nach der Beweislast. Setzt sich die Lehre des Autors durch, wäre dies eine Art Paradigmenwechsel in der Rechtstheorie ganz ebenso wie in der Rechtspraxis. |
Dominik Richers’s book presents a revolutionary yet logical and convincingly argued proposition. The burden of law allows a court to deal with uncertainties on points of law in much the same way as uncertainties on points of fact are resolved using the burden of proof. Should this principle catch on, it could potentially mark a paradigm shift in both legal theory and practice. |
