Inwieweit darf sich ein Musikstück an einem anderen orientieren, ohne Urheberrechte zu verletzen? Welche Rolle spielt dabei die Originalität des Werks und der Grundsatz der Ideenfreiheit? Wann wahrt ein solches Werk einen hinreichenden Abstand oder fällt unter die Schranke für Pastiches? Diese Fragen beantwortet die Arbeit mit Blick auf die deutsche und europäische Rechtsentwicklung. Urheberrechtliche Prinzipien und Dogmen werden dabei nicht nur in ihrer Anwendung auf musikalische Sachverhalte untersucht, sondern anhand der Erkenntnisse auch grundlegend hinterfragt. Die Arbeit bietet so einerseits eine praxisnahe Analyse maßgeblicher Kriterien des Musikurheberrechts und andererseits stellt sie urheberrechtliche Grundlagen auf den Prüfstand. |
To what extent may a piece of music be inspired by another without infringing copyrights? What is the role of originality and freedom of ideas in this context? When does such a piece maintain a sufficient distance to the protected work or fall under the exception for pastiches? Beaver introduces the reader to biosocial criminology, including the ways in which genes and the environment combine together to produce different antisocial outcomes. He then proceeds to provide an empirical examination of the genetic underpinnings to criminal behaviors by analyzing data drawn from the National Longitudinal Study of Adolescent Health (Add Health). The results of the analyses provide some evidence indicating that antisocial phenotypes are due to interactions between genetic and environmental factors. Beaver |
