"Gegenstand der Arbeit bildet die aus Skandinavien stammende Rechtsfigur der "Erweiterten Kollektiven Lizenz" ("extended collective license"), welche über die Erstreckung von Kollektivverträgen die



Lizenzierung von umfassenden Werkrepertoires an Nutzer ermöglicht. Trotz ihrer wachsenden Popularität ist die Erweiterte Kollektive Lizenz wissenschaftlich noch nicht annähernd erschöpfend behandelt worden. Vor diesem Hintergrund werden anhand einer umfassenden Analyse zunächst das Wesen, die Struktur sowie die maßgeblichen Aspekte dieser Rechtsfigur näher untersucht. Aufbauend auf diesen Erkenntnissen widmet sich die Arbeit anschließend der Frage, ob und inwieweit die Erweiterte Kollektive Lizenz im Einklang mit höherrangigem Recht in Deutschland und Europa in Zukunft nutzbar gemacht werden könnte. Gerade an der Nahtstelle von Exklusivität und Kollektivierung vermag das Modell in bestimmten Bereichen den erforderlichen Interessenausgleich im Urheberrecht zu gewährleisten."--Verl.
