• Sommario/riassunto: Das Strafrecht der Kirche steht vor einer Reform. Das erste Reform-Schema von 2011 für ein neues Buch VI des CIC wird in der römischen Kurie nach vielen Voten aus der Weltkirche bearbeitet. Wohin geht die Rechtsentwicklung der Kirche in diesem Bereich? Wann kommt das neue Strafrecht? Fragen, die auch in Zukunft aktuell bleiben. Das kirchliche Strafrecht steht seit 2010 im Interesse der Öffentlichkeit, wie selten zuvor. Die Entdeckung des Missbrauchs an Minderjährigen durch Bedienstete der katholischen Kirche hat sich nicht als ein lokal beschränktes, sondern ein globales kirchliches Phänomen erwiesen. Die ; ersten Reaktionen der Kirche waren rechtspraktisch und kommunikativ nicht gelungen, obwohl normative Vorgaben für eine sachgerechte Bearbeitung der Fälle hätten angewandt werden können. Hier gibt die Strafrechtsreform die Chance, verlorenes Vertrauen wiederzugewinnen. Eine weitere Problematik, die nicht nur rechtlich, sondern zuerst auch lehramtlich zu lösen ist, ergibt sich aus dem Umgang der Kirche mit Menschen, deren Lebensführung von der bisherigen Mehrheitsmeinung zur kirchlichen Lehre nicht gedeckt ist. Die Meinungen über die kanonistisch korrekte Subsumtion dieser Lebensschicksale unter die entsprechenden Normen weichen nicht nur in Deutschland, sondern auch im Vatikan voneinander ab. Das kanonische Strafrecht bearbeitet naturgemäß alle heiklen Fragen kirchlicher Rechtsfragen. Der Umgang damit wird die Glaubwürdigkeit der Institution Katholische Kirche auf Zukunft hin nachhaltig beeinflussen.
