|
War is usually considered a men's affair, where women would only play secondary roles. Although they are actresses and witnesses of history, they constantly see their experience devalued. Yet, given the scale of the conflicts of the nineteenth and twentieth centuries, the entire population was affected. Since women have mobilized in different ways, it seems important to promote a reading of the warlike phenomenon according to the prism of the genre. This book is part of this perspective. By collecting contributions from historians and writers, this book describes both the complexity of women's wartime experiences and their representations in literature. |

In Europa ist man sich einig: Das anwendbare Sachenrecht folgt der Belegenheit der Sache (lex rei sitae). Infolge dieser vermeintlichen Einigkeit sind die Vereinheitlichungsbemühungen der EU trotz der Bedeutung des internationalen Sachenrechts für den Binnenmarkt zurückhaltend. Befragt man aber die mitgliedstaatlichen Rechtsordnungen, was unter "Sachenrecht" oder einer "Sache" zu verstehen ist, bleibt vom Gesamtbild einer faktisch harmonisierten Anknüpfungsregel wenig übrig. Vor diesem Hintergrund lenkt Joseph Rumstadt den kollisionsrechtlichen Blick weg von den Objekten des Sachenrechts hin zu einem einheitlichen Mechanismus dinglicher Güterzuordnung. Er entwickelt daraus einen übergreifenden, im europäischen Recht verankerten Anwendungsbereich für ein internationales "Sachenrecht" für alle Vermögensgegenstände, den er rechtsvergleichend erprobt, von anderen Systembegriffen des europäischen IPR abgrenzt und schließlich in konkrete Normtextvorschläge gießt. |
