In June 1814 Anton Friedrich Justus Thibaut (1772-1840) concluded his Über die Notwendigkeit eines allgemeinen bürgerlichen Rechts in Deutschland (On the need for a general civil law for Germany).Probably in response to August Wilhelm Rehberg (Über den Code Napoleon und dessen Einführung in Deutschland, Hannover 1814), who only he appreciated custom and tradition. Shortly after this first edition, In August 1814, he prefaced the second one, which occupied treaty number 19 of his Civilistische Abhandlungen (pp. 404 ff.) and which included some additions qualified by the author himself as relevant, together with minor modifications of style. This last version was again published in 1840.The book sparked a well-known controversy over coding that inspired Savigny's controversial essay entitled Vom Beruf unserer Zeit für Gesetzgebung und Rechtswissenschaft (From the vocation of our age to legislation and the science of law).In 1914, the centenary year, Jacques Stern gave the printing press a new edition of these titles together with other texts: additions by the authors and judgments of his contemporaries. Stern's selection was translated by José Díaz García and published by Aguilar in 1970.Starting from this Spanish translation, with slight changes, the present work reproduces the second edition. The additions introduced by Thibaut They appear in italics so that they can be easily seen. When they are simple



modifications, in a mere form, the replaced text appears in note. Finally, it is obligatory to thank the rights holders for their ease in offering this digital edition for exclusively academic purposes.
