Dans son sens courant, la consultation est l’action de s’adresser à quelqu’un pour obtenir un avis, considéré comme une opinion, une information ou une recommandation, mais cette définition s’applique-t-elle à toutes ces procédures ? Si une étude empirique en droit public fait ressortir de nombreuses disparités, elle met en lumière un certain nombre de traits communs utiles à la construction d’une notion juridique. La consultation répond à un certain nombre de critères. Organiquement, elle est placée entre les mains d’une autorité dotée d’un pouvoir décisionnel. Temporellement, elle a vocation à influer sur une norme en préparation. Matériellement, elle se traduit par un avis qui clôt le processus consultatif. La thèse s’attache ensuite à mettre en lumière la tension que subit le phénomène consultatif aujourd’hui, pris entre la reconnaissance de son utilité et la volonté affichée d’en réduire l’utilisation. Substantiel, le mouvement de rationalisation et d’harmonisation des procédures entamé au début du siècle souffre, toutefois, de nombreuses exceptions, malgré l’objectif affiché.
