Ce livre tente d'établir un bilan historique, politique et juridique, de l'action des différents présidents de la République en ce qui concerne la protection, parfois aussi la restriction, des libertés fondamentales. Les chercheurs étudient en outre la palette des instruments juridiques dont les présidents se sont dotés pour agir dans ce domaine et comment le rôle du Président a pu être également variable en fonction des personnalités et des contextes politiques et sociaux. Des analyses générales de l'implication présidentielle alternent avec l'étude plus précise de quelques grandes libertés (vie privée, religion, expression, droits politiques...). Sont rassemblés les souvenirs de quelques « grands témoins » des différents mandats présidentiels comme Robert Badinter, Michel Charasse, Claude Guéant, Jean-Paul Costa... Mais cet ensemble réunit aussi certains des meilleurs spécialistes du droit public et de la science politique dans des analyses historiques et juridiques. |
