Con Hábitos coloniales, Kathryn Burns transforma nuestra imagen de las monjas como unas reclusas marginales, convirtiéndolas en actores centrales en el escenario virreinal. A partir de la fundación del primer convento sudamericano en 1558, Burns muestra que en el Cuzco las monjas desempeñaron un papel vital en el sometimiento de los incas, la creación de una elite criolla y la reproducción de un ordenamiento colonial andino, en el cual los intereses económicos y espirituales se encontraban fusionados de modo inextricable. Gracias a una investigación sin precedentes en los archivos, Hábitos coloniales muestra cómo fue que las monjas se convirtieron en las principales garantes del ordenamiento social de su ciudad haciendo préstamos, manejando propiedades, controlando a mujeres "díscolas" y criando niñas. Burns acuña la frase "economía espiritual" para analizar las intrincadas inversiones y relaciones que permitieron florecer a los conventos del Cuzco y sus auspiciadores, y así nos explica cómo esta economía, para finales del siglo XVIII, estaba tambaleándose, convirtiendo a los conventos en un emblema de la decadencia y un punto focal de intensas críticas a un régimen colonial en extinción. Para el siglo XIX las monjas habían abandonado sus papeles previos, marginadas en la construcción de un nuevo orden republicano. |

In a book that radically challenges conventional understandings of the dynamics of cultural imperialism, Shaden M. Tageldin unravels the complex relationship between translation and seduction in the colonial context. She examines the afterlives of two occupations of Egypt-by |

the French in 1798 and by the British in 1882-in a rich comparative analysis of acts, fictions, and theories that translated the European into the Egyptian, the Arab, or the Muslim. Tageldin finds that the encounter with European Orientalism often invited colonized Egyptians to imagine themselves "equal" to or even "masters" of their colonizers, and thus, paradoxically, to translate themselves toward-virtually into-the European. Moving beyond the domination/resistance binary that continues to govern understandings of colonial history, Tageldin redefines cultural imperialism as a politics of translational seduction, a politics that lures the colonized to seek power through empire rather than against it, thereby repressing its inherent inequalities. She considers, among others, the interplays of Napoleon and Hasan al-'Attar; Rifa'a al-Tahtawi, Silvestre de Sacy, and Joseph Agoub; Cromer, 'Ali Mubarak, Muhammad al-Siba'i, and Thomas Carlyle; Ibrahim 'Abd al-Qadir al-Mazini, Muhammad Husayn Haykal, and Ahmad Hasan al-Zayyat; and Salama Musa, G. Elliot Smith, Naguib Mahfouz, and Lawrence Durrell. In conversation with new work on translation, comparative literature, imperialism, and nationalism, Tageldin engages postcolonial and poststructuralist theorists from Frantz Fanon, Edward Said, and Gayatri Spivak to Jean Baudrillard, Walter Benjamin, Emile Benveniste, and Jacques Derrida. |

"Die Auseinandersetzung mit dem Rechtspositivismus vollzog sich in Deutschland seit dem Zweiten Weltkrieg vornehmlich im Blick auf den hier dominierenden analytischen Gesetzespositivismus und die Reine Rechtslehre Hans Kelsens, denen die „Radbruch´sche Formel“ zu begegnen versuchte. Das Spektrum der rechtspositivistischen Theorien umfasst aber mit analytischen, psychologischen und soziologischen Elementen in den Werken Theodor Geigers, H. L. A. Harts, J. Raz´ und anderer Autoren weitere Ansätze, Recht allein empirisch, nicht inhaltlich zu verstehen. Daraus ergeben sich durchaus unterschiedliche Konsequenzen, die auch ein differenzierteres Licht auf das Verhältnis von Recht und Moral werfen. Der Autor Walter Ott, schweizerischer Jurist und Rechtsphilosoph, charakterisiert als ein seit langem ausgewiesener Kenner der modernen Diskussion über den Rechtspositivismus die unterschiedlichen Positionen auf knappem Raum und demonstriert ihre Ergebnisse an einfachen Beispielen.
