ajoute une nouvelle pierre à l'édifice des études comparées entre le droit et la littérature au Moyen Âge, en particulier dans la chanson de geste. Il apparaît à la suite de ces études qui ont permis de considérer un vaste corpus de textes, incluant deux épopées latines majeures, que nos textes épiques du Moyen Âge, tout en reflétant une réalité, sont aussi les promoteurs d'une réflexion, soutenue par divers procédés fictionnels, sur les fautes humaines. Si le manichéisme épique reste toujours opérationnel, surligné par une une considération négative de la vie humaine entachée systématiquement de péché, se fait jour une vision bien plus nuancée, liée à la fois aux incertitudes du droit, à l'idée forte de l'importance d'un arbitraire du juge comme à la faiblesse d'un homme soumis à sa condition et à la force du hasard comme des passions. D'autre part, à côté de l'esthétique de la force dominant les épopées, les jongleurs mettent en œuvre une esthétique du judiciaire qui, en particulier, s'articule autour d'un jeu sur la faute et sur les multiples ambiguïtés de son jugement. |
