|
Darf der Staat nachträglich in einen verwaltungsrechtlichen Vertrag mit Privaten eingreifen und wenn ja, welches sind die Folgen? Obwohl Verträge des öffentlichen Rechts schon lange zum Rechtsalltag gehören, sind viele dogmatische Fragen in diesem Zusammenhang noch ungenügend geklärt. Diese Dissertation untersucht die nachträgliche Einwirkung des Staats und erstellt im Lichte der Bundesverfassung eine Auslegeordnung zu folgenden Fragen: Aus welchen Gründen darf der Staat nachträglich vertragliche Rechtspositionen des Privaten aufheben oder vermindern? Wie ist die private Vertragspartei grundrechtlich geschützt? Welche Ansprüche stehen ihr zu, wenn der Staat in dieser Art eingreift? Querbezüge zum Obligationenrecht werden ebenfalls betrachtet und in die Schlussfolgerungen einbezogen. |
