Troisième et dernière étape de la vaste enquête sur les cadastres du Moyen Âge à l’époque contemporaine, ce volume est consacré au développement des systèmes cadastraux en Europe aux XIXe et XXe siècles. Consacrant le droit de propriété et l’égalité des citoyens devant l’impôt, les Constituants ont décidé la réalisation d’un cadastre fiscal en mettant à profit les expériences des précédentes décennies. La loi du 15 septembre 1807 donne au cadastre parcellaire une efficacité supplémentaire en lui permettant de certifier la propriété et d’être un outil d’intérêt général. Les États européens l’ont inégalement adopté. Les Pays-Bas et les États allemands en font un Grand Livre foncier ; l’Italie et la France pendant longtemps un simple instrument fiscal. D’autres pays s’opposent à sa création, soit parce que les élites veulent rester maîtresses de la répartition de l’impôt comme en Espagne, soit parce que l’ingérence du pouvoir central dans la propriété privée est vécue comme une atteinte à une liberté fondamentale comme en Angleterre. Aujourd’hui, la récente arrivée du cadastre numérisé fait l’unanimité. Elle permet la représentation de la propriété, et plus largement, la gestion des responsabilités qu’elle induit. De plus, les collections anciennes lui confèrent une valeur patrimoniale inestimable. |
