Florian Wilksch untersucht, inwieweit im Krankenversicherungsrecht das verfassungsrechtlich garantierte Recht auf ein gesundheitliches Existenzminimum verwirklicht ist, wie dies im Rahmen der Fürsorge wirkt und welche Spannungen daraus entstehen. Dabei stellt er fest, dass der Gleichlauf zwischen Versicherungs- und Subsistenzsicherungsrecht unzureichend ist, da Legitimationsdefizite und materielle Deckungslücken bestehen. Daher wird ein existenzsicherungsrechtlicher Gesundheitsbegriff vorgeschlagen und beleuchtet, der sich am bio-statistischen Krankheitsmodell orientiert und durch die Grundbefähigungslehre angereichert wird.
