|
Fondée sur les articles 2 et 4 de la Déclaration des Droits de l’Homme et du Citoyen, la liberté personnelle est une notion développée par le Conseil constitutionnel depuis 1988. Distincte de la liberté individuelle au sens de l’article 66 de la Constitution, elle fonde désormais certaines des protections relevant de la liberté de l’individu et désignerait subsidiairement le « droit à ne pas subir de contraintes sociales excessives au regard de la personnalité ». S’appliquant dans les domaines du droit social (protection de la personnalité du salarié), du droit des étrangers (mariage, détention de documents d'identité), de la vie privée (protection des données personnelles), elle correspond parfois à la notion de “libre développement de la personnalité” que connaissent certains États européens ou que nourrit la jurisprudence de la Cour Européenne des Droits de l’Homme. Le présent ouvrage, issu du colloque organisé sous l’égide du Centre d’Études et de Recherches Constitutionnelles et Politiques de l’Université de Toulouse le 17 mai 2005, se propose, sous forme de tables rondes, d’étudier la liberté personnelle en droit constitutionnel puis d’en mesurer les prolongements en droits administratif, pénal, civil et social pour enfin déboucher sur une approche comparatiste afin d’en dégager les développements possibles. |
